You are granted a limited license to access and use the Site and the Services for your personal, non-commercial use only. This license does not include any resale or commercial use of the Site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Site or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

By submitting User-Generated Content, you grant birdjuice a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, publish, create derivative works from, distribute, and display such User-Generated Content in any media now known or hereafter developed.
You represent and warrant that you own or control all rights in and to the User-Generated Content and have the right to grant the license granted above. You acknowledge that birdjuice is not responsible for any User-Generated Content and does not endorse any User-Generated Content. birdjuice reserves the right to remove or refuse to post any User-Generated Content for any or no reason at its sole discretion.
By submitting User-Generated Content, you agree to indemnify and hold harmless birdjuice from any claims arising out of or related to your User-Generated Content, including any claims of infringement of intellectual property rights or defamation.
Some Services may require payment of fees ("Fees"). By using such Services, you agree to pay all applicable Fees and any taxes associated with your use of the Services. All Fees are non-refundable unless otherwise stated. birdjuice reserves the right to change its Fees at any time, with notice to you.
You agree to provide accurate and complete payment information when you make a purchase. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) you use to make a purchase. If your payment method fails or your account is past due, we may suspend or terminate your access to the Services.
In the event of a dispute regarding any Fees, you must notify us in writing within thirty (30) days of the date of the charge. Failure to notify us within this timeframe will result in your waiver of any claims related to such Fees.
Birdjuice reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that birdjuice will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.
We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability. Any new features that augment or enhance the current Services shall also be subject to these Terms.

To the fullest extent permitted by applicable law, in no event shall birdjuice, its affiliates, licensors, or service providers, or their respective officers, directors, employees, agents, contractors, successors, or assigns be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the Services.
In no event shall birdjuice’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Services. The foregoing limitations will apply even if the above-stated remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
If you wish to terminate your User Account, you may simply discontinue using the Services or contact us at orders@birdjuice.com. Upon termination, you may lose access to all User-Generated Content associated with your User Account.
